Terms of Use

Effective Date

Introduction

These Website Terms of Use govern your access to and use of the Get Care at Home website. By accessing or using this website, you agree to these Terms of Use. Please do not use the website if you do not agree to these terms.

1. About Get Care at Home

Get Care at Home is a California non-medical home care agency. We provide non-medical assistance and support that may include companionship, supervision, personal care assistance, meal preparation, light housekeeping, medication reminders, respite, dementia support, and assistance with activities of daily living. The precise services provided to a client are determined through an assessment and a separate written service agreement.

2. No Medical Services or Medical Advice

Get Care at Home does not provide medical diagnosis, medical treatment, skilled nursing, emergency medical services, or medical advice through this website. Website content is provided for general educational and informational purposes. It is not a substitute for advice from a physician, nurse, pharmacist, mental health professional, attorney, financial professional, or other qualified professional. You should consult an appropriate licensed professional regarding medical symptoms, medication concerns, treatment decisions, changes in health, or other clinical matters.

3. Emergencies

Do not use this website, a website form, email, or social media to report an emergency. Call 911 immediately when a person may be experiencing a medical emergency, immediate danger, abuse, neglect, exploitation, wandering emergency, suicidal crisis, or other urgent safety concern. Website messages may not be reviewed immediately.

4. No Caregiver-Client Relationship Created

Visiting the website, submitting a form, requesting a consultation, sending an email, or speaking with a representative does not create a client relationship, caregiver relationship, fiduciary relationship, or contractual duty. A service relationship begins only after Get Care at Home completes its required process and the appropriate parties sign a written service agreement. We may decline a service request when we cannot safely, legally, appropriately, or operationally provide the requested care.

5. Website Information Is Not a Service Guarantee

We try to keep website information accurate and current. However:

- Services may differ by location

- Caregiver availability may change

- Rates and minimum service requirements may change

- Specific services may be subject to assessment

- Some needs may fall outside the lawful scope of non-medical home care

- Insurance, public benefits, or third-party programs may have separate rules

- Website information may contain errors or become outdated

Nothing on the website guarantees caregiver availability, service eligibility, approval by a third-party payer, a particular outcome, or a specific rate.

6. Service Areas

References to cities, counties, communities, or service areas do not guarantee that services are available at every address. Availability may depend on staffing, travel distance, scheduling, safety, the client’s needs, and applicable licensing requirements.

When you provide your telephone number, you authorize us to contact you regarding your inquiry, requested services, scheduling, client care, employment application, or existing relationship. Promotional or marketing text messages will be sent only when permitted by law and based on the consent provided. Consent to receive marketing text messages is not required as a condition of purchasing services. Message and data rates may apply. Message frequency may vary. Reply STOP to opt out of promotional text messages. Reply HELP for assistance. Carriers are not responsible for delayed or undelivered messages.

Information concerning employment, caregiver opportunities, compensation, scheduling, benefits, assignments, or qualifications is general and may change. Submitting an application does not:

- Guarantee an interview

- Guarantee employment

- Guarantee a client assignment

- Create an employment contract

- Alter the at-will nature of employment when applicable

Applicants may be required to satisfy background-check, training, licensing, registration, health-screening, work-authorization, driving, reference, and other lawful requirements.

10. Intellectual Property

Get Care at Home does not control, endorse, warrant, or accept responsibility for third-party content, services, policies, availability, or security. You use third-party websites at your own discretion.

18. Governing Law and Venue

These Terms of Use are governed by the laws of the State of California, without regard to conflict-of-law principles. Any legal action concerning the website or these Terms of Use must be brought in a court of competent jurisdiction located in Sacramento County, California, unless applicable law requires otherwise.

19. Severability

If any provision of these Terms of Use is found unenforceable, the remaining provisions will remain in effect. The unenforceable provision will be interpreted as closely as possible to its lawful intended purpose.

20. No Waiver

A failure by Get Care at Home to enforce any provision does not waive the right to enforce that provision later.

21. Entire Agreement
